These Terms and Conditions apply to the use of this website at www.newquayairporttaxis.org.

By accessing this website and/or placing an order, you agree to be bound by these terms and conditions.

Using this website indicates that you accept these terms regardless of whether or not you choose to register with us or order from us. If you do not accept these terms, do not use this website.

1. INTRODUCTION

1.1        You will be able to access most areas of this Website without registering your details with us. Certain areas of this Website are only open to you if you register.

1.2        We may revise these terms and conditions at any time by updating this posting. You should check this Website from time to time to review the then current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of this Website. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use this Website.

 

2. ORDERING FROM US

2.1        You can only purchase taxi services from us and are deemed to place an order with us (i) by ordering via our online booking & checkout process (ii) when you place a booking for taxi services and intend to pay by cash/chip & pin. As part of our checkout process you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement in the form of your taxi booking confirmation, detailing the products/services you have ordered.

2.2        Our acceptance of an order takes place when we send you confirmation of your taxi booking.

2.3        We may refuse to accept an order:

(a)        where we cannot obtain authorisation for your payment;

(b)        if we think we are unable to meet your requirements;

(c)        if there has been a pricing or product description error; or

(d)        if you do not meet any eligibility criteria set out in our terms and conditions.

3.        PRICING

3.1        Our prices do not include VAT as we are not registered for VAT.

3.2        If we begin to charge separately for packing, carriage and insurance and other relevant charges, the appropriate rates will be set out in a specified pricing structure shown in an additional file when applicable. We currently do not charge for this.

 

3.3        Our prices are reviewed regularly. Prices are confirmed and locked in at the time of booking and will not change after your booking has been confirmed.

3.4        Our prices are inclusive of any charges for travelling to or from Newquay Airport and our base postcode.

 

4.         CANCELLATION AND REFUND POLICY

4.1        If you wish to cancel your order/booking:

(a)        you must obtain a cancellation number from us.

(b)        you can notify us through the website by email or by text or telephone call using the information provided in your taxi booking details, subject to the following;

(c)        where taxi bookings have been made and confirmed,

(i)         if your taxi is collecting you from Newquay Airport, you can cancel the service at any time up to 60 minutes before the specified booking time. Failure to cancel your taxi service within this time limit will result in a £30 fee being payable by you to compensate for loss of business during the time period used to attend the airport and wait when you do not intend or are unable to take up the service, or

(ii)        if your taxi is collecting you from a different location, you can cancel at any time before the start of the estimated travel time in minutes from Newquay Airport to the pickup location if greater than 60 minutes (for example, if the travel time from Newquay Airport to the pickup location is 98 minutes, then you can cancel up to 98 minutes before the specified pickup time), but otherwise no less than 60 minutes before the specified pickup time. Failure to cancel your taxi service within this time limit will result in the total taxi fare being chargeable.

(d)        where a deposit has been taken in advance to secure a booking, with a balance still to pay,  the deposit monies paid are non-refundable under any circumstances.

(e)        please note that taxi bookings are for a specific date and time and are therefore exempt from the standard 14-day cooling-off period under Regulation 28(1)(h) of the Consumer Contracts Regulations 2013;

4.2        Refunds & Charges:

(a)        provided the booking is cancelled within the limits stated in 4.1, and within 60 days of original payment, a full refund will be available to the original payment method within 10 working days. If the booking is cancelled after 60 days of card payment, a processing fee of up to 5% may apply to cover third-party payment processing costs.

(b)        if your taxi is collecting you from Newquay Airport, and the booking is NOT cancelled within the limits stated in 4.1, where the monies paid by you in advance are less than £30 no refund will be made and an invoice for the balance to £30 will be issued. If the monies paid in advance are more than £30, a refund will be made less £30 and subject to 4.2 (a).

(c)        if your taxi is collecting you from a different location, and the booking is NOT cancelled within the limits stated in 4.1, where the taxi Fare has been paid by you in advance no refund will be made. If the taxi Fare has not been paid in advance an invoice will be issued for the full taxi Fare even though you have not used the service.

4.3       No-Show Policy
A booking will be treated as a no-show if the passenger is not present and not contactable:

(a)         when the pickup location is Newquay Airport – 5 minutes after the included 30 minute airport waiting time stated in Section 6.4, and reasonable attempts have been made to contact the passenger using the details provided at booking.

(b)        when the pickup location is NOT Newquay Airport – 15 minutes after the scheduled pickup time, and reasonable attempts have been made to contact the passenger using the details provided at booking.

In the event of a no-show:
(a)        Any prepayments made are non-refundable.
(b)        If the fare has not been prepaid, the full fare plus any waiting/parking charges incurred will be invoiced and must be paid in full.
(c)        The booking will be closed, and the driver will be released from duty.

4.4 Conversation Preferences — Duty to Notify During Journey
Our drivers are there to get you safely to your destination, but also to be personable and maintain good customer service through conversation when required. If at any time during the journey you would prefer no conversation or do not wish to discuss a particular topic, you must inform the driver immediately. Our drivers will always aim to keep conversation professional and neutral, and avoid personal or contentious topics. On request, the driver will promptly stop or change the topic and keep conversation to a minimum for the remainder of the journey. You may also request a “Quiet Ride” at booking or at pickup. If no concern is raised during the journey, we will assume the conversation was acceptable at the time and that we were not given a reasonable opportunity to put things right.

 

4A. TERMS & CONDITIONS OF CHILD SEAT USE

These Terms & Conditions apply to the provision and use of child car seats supplied by our service.
By requesting and using a child seat, you confirm that you have read, understood, and agreed to the following:

4A.1. Responsibility for Seat Selection

It is the parent’s or guardian’s sole responsibility to ensure that the correct type of child seat is chosen based on the child’s age, weight, and height, in accordance with current UK laws and safety guidelines.

We may provide general information regarding child seat options, but this does not constitute legal or safety advice.

4A.2. Courtesy Provision Only

  • Child seats are provided as a courtesy for the convenience of our customers.

  • The provision of a seat does not imply that it is suitable for your child or that it complies with your specific legal or safety obligations.

4A.3. No Liability Accepted

We accept no liability or responsibility for any of the following:

  • Incorrect selection of seat by the parent or guardian

  • Incorrect installation, adjustment, or usage of the seat

  • Any injury, loss, or damage resulting from the use of a child seat provided by us

We will provide child seats that are regularly checked for wear and damage. However, it remains the parent’s responsibility to ensure the seat provided is suitable for their child and is correctly fitted.

4A.4. Parent/Guardian Obligations

By requesting and using a child seat, you agree that:

  • You have provided accurate information about your child’s age, weight, and height.

  • You will personally check the seat before travel to ensure it is suitable and correctly installed.

  • You assume full responsibility for your child’s safety while using the seat.

4A.5. Acceptance of Terms

By booking a journey and requesting a child seat, you acknowledge and accept these Terms & Conditions in full.
If you do not agree, you must decline the use of our child seat service and provide your own compliant seat.

 

5.        LICENCE

5.1        You are permitted to print and download extracts from this Website for your own use on the following basis:

(a)        no documents or related graphics on this Website are modified in any way;

(b)        no graphics on this Website are used separately from accompanying text; and

(c)        any of our copyright and trade mark notices and this permission notice appear in all copies.

5.2        Unless otherwise stated, the copyright and other intellectual property rights in all material on this Website (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and  conditions, any use of extracts from this Website other than in accordance with clause 5.1 above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use this Website automatically terminates and you must immediately destroy any downloaded or printed extracts from this Website.

5.3        Subject to clause 5.1, no part of this Website may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.

5.4        Any rights not expressly granted in these terms are reserved.

 

6.        SERVICE ACCESS & PROVISION

6.1        While we endeavour to ensure that this Website is normally available 24 hours a day, we will not be liable if for any reason this Website is unavailable at any time or for any period.

6.2        Access to this Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond our control.

6.3       While we endeavour to provide taxi services to your destination in a professional and timely fashion, we will not be liable for any delays due to vehicle breakdown, accident or traffic & road conditions. The person booking the taxi service is responsible for ensuring there is enough time allowed for the taxi journey.

6.4       Flight Monitoring & Waiting Time – we monitor incoming flights when a valid flight number is provided. 30 minutes waiting time from scheduled or actual landing (whichever is later) is included. Thereafter, waiting/parking is chargeable at £2.00 per 5 minute interval.

6.5        We are not liable for delay or failure caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, road closures, major traffic incidents, industrial action, and police operations.

6.6        Complaints – please email bookings@newquayairporttaxis.org. We aim to respond within 5 working days and resolve within 10 working days.

6.7        Safety & Right to Refuse Carriage – we may refuse or terminate a journey where carriage would be unsafe or unlawful, including (without limitation) where a passenger is violent, abusive, severely intoxicated, attempts to exceed legal seating capacity, insists on carrying unsecured children without appropriate restraints, or seeks to transport hazardous items. In such cases, the fare (or a reasonable portion thereof) remains payable.

6.8        Luggage & Child Travel – standard luggage allowance is one medium suitcase and one small bag per passenger, subject to vehicle capacity and safety. Oversized/excess items must be disclosed in advance and may incur additional charges or require a larger vehicle. Children, including a babe in arms, count toward the vehicle’s maximum seating capacity. While the correct child restraint should always be used wherever possible, certain licensed taxis and private hire vehicles in the UK are legally exempt if an appropriate seat is not available. In these cases, children under 3 years old must travel on the rear seat and may sit on an adult’s lap, while children aged 3 years and over must use an adult seatbelt if no child seat is available. See Section 4A for further details and your responsibilities.

6.9        Lost Property – if you believe you have left an item in one of our vehicles, please contact us at bookings@newquayairporttaxis.org or on 01637 415161 with your booking details. We will take reasonable steps to locate and store found items for 30 days. Return may be arranged for collection or by post/courier – which you must arrange at your cost; an administration fee of £15 may apply.

6.10      Tolls, Drop-Off & Parking Fees – Any road tolls, congestion/clean-air charges, airport drop-off/parking fees, or similar third-party charges incurred during your journey as a result of passenger instruction, are payable by the passenger in addition to the fare (unless expressly included in your quoted price).

6.11      Conversation & Quiet Ride Preference
Drivers will always endeavour to keep conversation professional and will immediately stop or avoid any topic on request. You are responsible for communicating any conversation preferences promptly during the journey. If you’d prefer no conversation or want a topic to end, please tell the driver at any time — they’ll stop immediately. You may also request a Quiet Ride at booking or at pickup, and we will instruct the driver accordingly.

 

7.        VISITOR MATERIAL AND CONDUCT

7.1        Other than personal data, which is covered under our Privacy Policy at www.newquayairporttaxis.org/privacy , any public submission material (e.g., reviews) you transmit or post to this Website may be used by us to operate, improve, and promote our services. We will have no obligations with respect to such material. We and our nominees will be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes. We comply with UK GDPR and will process your personal data in accordance with our Privacy Policy.

7.2        You are prohibited from posting or transmitting to or from this Website any material:

(a)        that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience;

(b)        for which you have not obtained all necessary licences and/or approvals;

(c)        which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in the UK or any other country in the world; or

(d)        which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).

7.3        You may not misuse the Website (including, without limitation, by hacking).

7.4        We will fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting any material in breach of clauses 7.2 or 7.3.

We have not reviewed all of these third party websites and do not control and are not responsible for these websites or their content or availability. If you decide to access any of the third party websites linked to this Website, you do so entirely at your own risk.

8.2        If you would like to link to this Website, you may only do so on the basis that you link to, but do not replicate, the home page of this Website, and subject to the following conditions:

(a)        you do not remove, distort or otherwise alter the size or appearance of the NewquayAirportTaxis.org logo;

(b)        you do not create a frame or any other browser or border environment around this Website;

(c)        you do not in any way imply that we are endorsing any products or services other than our own;

(d)        you do not misrepresent your relationship with us nor present any other false information about us;

9.        REGISTRATION

9.1        To register with www.newquayairporttaxis.org you must be over eighteen years of age.

9.2        Each registration is for a single user only. We do not permit you to share your user name and password with any other person nor with multiple users on a network.

9.3        Responsibility for the security of any passwords issued rests with you and if you know or suspect that someone else knows your password, you should contact us immediately.

9.4        We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.

 

10.        DISCLAIMER

10.1        While we endeavour to ensure that the information on this Website is correct, we do not warrant the accuracy and completeness of the material on this Website. We may make changes to the material on this Website, or to the products and prices described in it, at any time without notice. The material on this Website may be out of date, and we make no commitment to update such material.

10.2        The material on this Website is provided “as is” without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, we provide you with this Website on the basis that we exclude all representations, warranties, conditions and other terms (including, without limitation, the conditions implied by law of satisfactory quality, fitness for purpose and the use of reasonable care and skill) which but for these terms and conditions might have effect in relation to this Website.

10.3        We do our utmost to be as timely and professional as possible but cannot guarantee to get you to your destination at any specific given time, or within a specific time frame, it is the responsibility of the person booking the service to ensure sufficient travel time is allowed, and nor do we accept any liability for loss or damage of any kind due to traffic hold-ups, accidents, road closures or anything out of our control. In the event that the vehicle you are travelling in breaks down, we will endeavour to help you continue your journey as soon as is possible by reasonable means, but accept no liability for loss or damage of any kind due to these eventualities.

 

11.        LIABILITY

11.1        We, any other party (whether or not involved in creating, producing, maintaining or delivering this Website), and any of our group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with this Website in any way or in connection with the use, inability to use or the results of use of this Website, any websites linked to this Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing this Website or your downloading of any material from this Website or any websites linked to this Website.

11.3        We will provide our taxi services with reasonable care and skill. However, we cannot be held responsible for delays or losses caused by events beyond our control, such as traffic incidents or road closures.

11.5        You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs (including reasonable legal fees) arising out of any breach of the terms and conditions by you, or your use of this Website, or the use by any other person using your registration details.

12.1        These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.

12.2        We do not warrant that materials/items for sale on the Website are appropriate or available for use outside the United Kingdom. It is prohibited to access the Website from territories where its contents are illegal or unlawful. If you access this Website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.

 

13.        MISCELLANEOUS

13.1        You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions

13.2        If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.
